Terms of Service
1. Definitions
- Service — the Qualone web application available at qualone.net, including related notification interfaces (Telegram bot, email reports).
- Operator — the party providing and technically maintaining the Service. The Operator's details and any special terms are set out in the agreement with the Organisation.
- Organisation — a legal entity or entrepreneur (a real-estate agency or other company) that has entered into an agreement with the Operator for the use of the Service.
- User — an individual granted access to the Service by the Organisation (workspace owner, manager, or observer).
- Organisation Data — information flowing into the Service from the Organisation's CRM and entered by its Users: deals, comments, pipeline stages, manager performance indicators, workspace settings.
2. Subject matter and acceptance
2.1. These Terms govern the use of the Service by Users. By using the Service (including signing in), the User confirms having read these Terms and the Privacy Policy and accepts them.
2.2. The Service is intended for professional use by Organisations. The relationship between the Operator and the Organisation (scope of services, fees, support levels) is governed by a separate agreement, which these Terms do not replace.
3. Access to the Service
3.1. Access is by invitation only: accounts are created by the Operator (integrator) or by an authorised administrator of the Organisation. Public self-registration is not available.
3.2. Each User is assigned a role (owner, manager, observer) that defines the scope of available actions. Roles are assigned and changed by the Organisation's workspace owner or by the Operator.
3.3. Sign-in is performed with the User's email address using a password, a Google account, or a one-time link sent to the User's email.
4. Account and security
4.1. The User undertakes to:
- keep sign-in credentials (password, sign-in links) confidential and not share them with third parties;
- use only their own account;
- promptly notify the Organisation's administrator or the Operator of any unauthorised access or account compromise.
4.2. Actions performed in the Service under the User's account are deemed performed by the User unless proven otherwise.
5. Acceptable use
5.1. When using the Service, it is prohibited to:
- attempt unauthorised access to other organisations' data, other users' accounts, or internal components of the Service;
- interfere with the normal operation of the Service, including circumventing security controls, automated data collection (scraping), or generating excessive load;
- copy, decompile, or modify the Service's code, or create derivative works based on it;
- use the Service in a manner that violates applicable law or third-party rights.
5.2. The Operator may restrict or suspend access upon detecting a violation of this section pending investigation.
6. Organisation Data
6.1. Organisation Data belongs to the Organisation. The Operator processes it solely to provide the Service, as described in the Privacy Policy.
6.2. Each Organisation's data is logically isolated: Users can only access their own Organisation's data within the limits of their assigned role.
7. Analytics
7.1. The Service produces analytical indicators (scores, rankings, detected process violations) automatically, including with the use of artificial-intelligence technology for evaluating the quality of managers' comments.
7.2. Such indicators are informational and supportive in nature: they highlight areas of attention and do not constitute a standalone basis for employment, disciplinary, or other legally significant decisions. The Organisation is responsible for interpreting the indicators and for decisions made on their basis.
8. Intellectual property
8.1. Exclusive rights to the Service — its code, interfaces, design, and the "Qualone" mark — belong to the Operator or its licensors.
8.2. The User is granted a limited, non-transferable right to use the Service for its intended purpose for the duration of their access. No other rights are granted.
9. Availability and changes
9.1. The Service is provided "as is" and "as available". The Operator strives to keep the Service stable but does not warrant uninterrupted operation, including interruptions caused by maintenance, updates, infrastructure failures, or circumstances beyond the Operator's reasonable control.
9.2. The Operator may change the Service's features, metrics, and design. Material changes affecting the Organisation's work will be communicated by reasonably accessible means.
10. Liability
10.1. To the maximum extent permitted by applicable law, the Operator is not liable for indirect damages, lost profits, or loss of data arising from the use of, or inability to use, the Service.
10.2. The Operator's aggregate liability towards the Organisation is limited to the amount paid for the Service for the period in which the liability arose, unless otherwise provided by the agreement with the Organisation or mandatory provisions of applicable law.
10.3. Nothing in these Terms limits liability that cannot be limited by law.
11. Suspension and termination
11.1. A User's access may be suspended or terminated: by the Organisation's administrator; or by the Operator — upon a breach of these Terms, upon expiry of the agreement with the Organisation, or at the Organisation's reasoned request.
11.2. Termination of access does not affect provisions that by their nature should survive (intellectual property, limitation of liability, confidentiality).
12. Changes to these Terms
12.1. The Operator may amend these Terms. The new version is published on this page with its date; material changes are additionally communicated to the Organisation. Continued use of the Service after publication constitutes acceptance of the new version.
13. Governing law and disputes
13.1. These Terms are governed by the law specified in the agreement between the Operator and the Organisation; absent such specification — by the law of the Operator's country of incorporation.
13.2. Disputes shall be resolved through negotiations and, failing agreement, by a competent court in accordance with applicable law.
